My wife last time entered to US with H4 in June 2010. Then she applied for F1 status and got approved in Nov 2010.
H4 visa stamping Expires on Feb 20111.
She is planning to go India by Jan 2011 for 2 weeks. She is planning to come before Visa expires.
Is it possible to enter US with old H4 visa stamping?
Do we really need to stamp visa with F1?
F1 visa stamp is needed if she plans to continue her studies on F1 and would like to avail OPT.

I have applied I 140 on Jul 6th and got the APPROVAL on Jul 18th from Texas centre :) ... never got a receipt notice... but i know of some of my friends who got a receipt notice before approval ..

I have two I -140's approved with one PD from end of 2005 and other end of 2006 both on EB2. I 485 is based based on 2nd one in 2006. So question is can I port 2005 pd to I 485 based on 2006?
Some where I heard that you can only port the PD when your 2nd is application stage and is pending. but here it is applied and already approved. Is it a good case for Porting PD or interfiling?
And by the way what is the difference between porting and interfiling?

Porting and interfiling are pretty much same ...( some use interfiling to use cross changeability ) .
you should be able to use your old PD ...Just ask your attorney to contact USCIS with your old I 140. and New I 140. Lot if times USCIS automatically links your PD's . But again its USCIS?? Just follow up with your attorney , you can take a infopass and show them your documents ( some officers are Info pass know the issue and will help you )

Its good to hear that GC holders are also willing to help us. Have them register on our site and request them to make phone calls. If you know US citizens tell them too. Tell them to mention that they are US citizens when they call lawmakers.

Guys,
I found some new information and it seems that few people who are still waiting may get some clue if not complete idea. Basically I found that when your PD is current the the IO will initiate the FP, Namecheck, IBIS check again when your AOS is in "Final Approval, Visa Available" state. Some IOs would just refresh the FP they have on file and some request another . But namecheck is something that you have to go through again. So if you get stuck in namecheck again, then that could be the reason for the delay since NC takes forever.
Can you please share the source of this info?
Is it a learned experience or from a published source ?
Any info is highly appreciated.

I am from PA. I am a June filer. My wife who is a primary applicant, got EAD for her and our son in the first week of Aug(after finger printing). I did not get my EAD so far. I had been to Philadelphia after getting INFOPASS appointment last week. Nothing happened there, just waste of time! It seems that there are no rules/ regulations in this system. Many of my friends got their EAD before FP. One of my friends got his GC without I-140 approval. The whole GC system is in big mess.

The USCIS Webmaster has returned to work. His EAD must have expired on Friday hence the site must have gone down, but the new one is approved and hence the site is up.

Please forgive my ignorance Gurus but I want to know when EAD is approved, how would one receive a SSN? Does that need to be applied separately at the local SSA office? If yes, then as per my understanding this would mean a further delay before one can start work, since it takes some time to receive a SSN.
Correct me if I am wrong.
I am referring a common scenario for all H4 visa holders who do not have a SSN.
Please share some knowledge on this.

The new fee structure goes into effect Aug 17.
I vaguely remember reading an anecdote that there is no need to pay yearly renewal fees in the new fee structure. (Am I right?) Please share your views.

The list of applicants who must obtain an Advance Parole document before traveling outside of the United States is as follows:
� Applicants that have been granted Temporary Protected Status (TPS);
� Applicants with a pending application for adjustment of status to lawful permanent resident (LPR);
� Applicants with a pending application for relief under section 203 of the Nicaraguan Adjustment and Central American Relief Act (NACARA 203);
� Applicants with a pending asylum application; or
� Applicants with a pending application for legalization

So before I-485 becomes current, as long as I-140 gets approved, then we are okay to lose current job, either laid off or change job? I think I-140 approval doesn't take long, right? It's just I-485 takes forever?
I'm quite new to this process. My employer just filed Labor Certificate last week. I'm also a little worried if my employer goes bankruptcy some day.

No the process must be completely restarted if you loose your job after I-140 approval.The only thing you get is the priority date.If your I-485 is already applied and it is pending for 180 days then there is no issue and you are safe.
