    I am having a proiblem with the I140 approval and I485 visa requested in wrong category. My Labor Certification is filed in EB3( BS with 2 plus years of experience). The company does not want to take risk hence filed in EB3 category.
    After the labor certification is approved I filed my I140 in EB2 with the appropriate documentation qualifying for the upgraded/change position with additional skills and my I140 got approved in EB2 and the approval has 203 (b) 2.
    After filing I485, interview is scheduled and the officer satisfied that the documents are sufficient and I am approveable the Immigration Officer requested visa number and came back saying no visa number is available hence we need to wait. At the time of interview(Ocotber 2005) both EB3 and EB2 are retrogressed. The officer did not give any sort of documents hence did not know anything such what category he requested what code did he use.
    In July 27th the Immigration Officer mentioned that the previous officer requested the visa number in EB3(E37). I spoke with an attorney who said that it is possible to change and hence taken the steps to correct the error/mistake of wrong EB Category.Because of this wrong category I did not get visa number.
    What are my chances that the USCIS goes back and corrects the error and put back in EB2 and request number in E21 or E26.I already sent the letters of my I140 approval, receipt of I140. What process should I take apart from reaching out CIS Ombudsman, Congresswoman,Senator,self letter addressing to the USCIS about the error and the potential long waiting periods for no fault of mine.
    Any suggestions?

    While these significant reductions affected the overall decline in foreign student enrollment, the number of offers of admission to students from the People's Republic of China grew at a rate of 13 percent. The CGS press release indicates that this was the fourth year in a row of double-digit growth in the number of students from China offered admission to U.S. graduate schools.

    With the up coming biggest education Expo in China (http://www.phdchina.org/english/index.shtml), the US is the country of Honour at this show. This is a clear sign that Chinese students are looking at the US as the main destination for studies and future opportunities.

    There is a significant economic contribution made by foreign students in tuition and related expenditures, as well. Generally, a foreign student is required to pay tuition at the much higher out-of-state rate, even when attending a state school. The potential of Chinese students boosting the economy is significant and should not be ignored.     Hi,

    My I-140 is pending, and my H1B renewal is also pending. Can I travel to India? If yes, what will I show as proof at re-entry?

    How will it be for my wife? She is on F1 going on to OPT and a pending I-485 linked to my I-140 application.

    I suggest you do premium processing of H1 extension or wait until approval. As far as your wife is concerned, I am not clear if she has a visa stamp. If not she can enter on AP.

    My wife recently returned from India and at port of entry, the officer incorrectly wrote the paroled until date as Jul 12, 2010 instead of Jul 12, 2011. The date is incorrect on both I-94 and AP.

    Will this create any issues and how can this be corrected? Her status is AOS pending, she doesn't have a EAD or H-visa

    My wife's AP is valid till Oct 12, 2010. I would appreciate any help

    Hi,

    I have received the EAD card yesterday with No finger prints available. But we have done our Finger printing before the EAD is approved. Approx 4 weeks before.

    Is this normal? Or i should contact USCIS about this?

    I know some applicants getting their EAD cards before finger prints were taken for them No finger prints available makes sense.

    Any responses are appreciated

    Same happened to me. I had my FP before receiving the EAD card but the card still showed FP not available. To be honest I didnt care so much ;)

    Hi Everyone,

    Need some inputs urgently. I recently joined a company. They had posted job offering all over the place without much success. Finally they decided to hire me on H1.

    Now while initiating the Green Card process, I am being told
    "Nothing can be used from our original recruiting as there are strict guidelines on the resources that must be used for the recruiting (i.e. posted on our website for 10 days and screen shots taken every day, etc.). Everything needs to be started from scratch"

    Is this correct? What is the correct process in PERM?

    Here is what the Attorney's office says:
    "The entire labor certification process, from initial preparation to recruitment to approval of the application, takes about 6 months. However, we will work very closely with your office to complete the necessary steps in the least amount of time feasible. Once we receive the inputs from your office, we will work with you to prepare the job description and minimum requirements. Once that is finalized we will identify the recruitment options and begin recruitment. We must file the application within 180 days from the first date the recruitment begins. Our target date to file is 90 days after the first date the requirement begins"

    Please advise. Is all the above correct or is there something being quoted incorrectly.

    My friend has a GC since Sep 2004. He recently went to India and married a person who has a stamped F-1 Visa though she has not entered the USA yet. They are planning to enter US this month. Is this legal? What should they be worried about and what are my friend's options if he wants to settle down with his wife in the USA. Will there be an complications if he applies for her GC or should he rather wait till he gets his Citizenship. Any comments would be appreciated

    If this is true then some of the concurrent filers will try to upgrade them to PP.I will be surprised if they do that. But crazier things have happened.
    I really doubt it, with all the current workload, USCIS can't take I-140 PP. That will further slow down the receipts.They have enough work for this year. Providing receipts, EAD, AP etc for more than 100,000 applicants.

    Can someone tell me what is a good lawyer??? I think this term is very much like good politician.. They are extinct...
    If someone using company lawyer to file I-485 and other forms, ask this lawyer will he send receipt notices to the applicant or not. Some will get answer that it's company policy not to sent anything to applicants :mad: .
