10/23/2007: Senate Passed Legislation to Recapture 61,000 Unused Numbers for Allied Healthcare Workers
* In the legal immigration, the allied healthcare community has strongest lobbying groups in the nation. These groups were able to muscle passage of a legislative bill in the Senate yesterday recapturing 61,000 unused EB-3 foreign worker visa numbers for them. This bill was passed as part of the Labor-HHS 2008 appropriation bill. Reportedly, this bill faces two roadblocks ahead to make it into a final legislation. One is the White House that has been threatening to veto the Labor-HHS bill in toto because of the amount of spending. Second is the House that has to agree to the Senate version in the conference committee. However, the second roadblock does not seem to pose any serious threat as demonstrated by the move of some of Democrats in the House. Please stay tuned.

given the priority date and the processing dates i want to understand how the uscis will process our applications
now the Nebraska service center is processing June 8, 2008. so based on the priority date it is processing all the applications that are current and have been filed before June 8th. Now let us say they take an application and start processing it and suddenly the PD goes back and I am not current any more - what do USCIS do. Do they just stack it back or what do they do. any thoughts.

Is there any way that we can get the USCIS to update their Aug 2007 bulletin and write on top of it and the July bulletin was valid till Aug 17th.
That way any officer who would check the Aug 2007 bulletin would first see the update and go by the July bulletin instead of rejecting I-485's in a bunch which cause additional hardships to the applicant in getting it reopened via MTR and again going through the long process.

Great Analysis from AILA to share with our readers. PL 111-230 requires the submission of an additional fee of $2,000 for certain H-1B petitions (http://www.h1b.biz/lawyer-attorney-1137085.html) and $2,250 for certain L-1A (http://www.h1b.biz/lawyer-attorney-1137416.html) and L-1B petitions postmarked on or after August 14, 2010. Petitioners subject to this new fee include employers with more than 50 employees in the U.S., for which 50% of their workforce is on H and L visas. The fee will remain in effect through September 30, 2014.
USCIS indicated that Vermont Service Center and California Service Center were instructed to hold any H or L petitions sent after that date, pending guidance on how to determine whether the petitioner is subject to the new fee. USCIS will be modifying the I-129 or H-1B Data Collection Form to include information on whether this fee applies.
In the interim, USCIS suggested that petitioners could proactively include a �certification� regarding the fee, including a notation of whether the fee is required in bold capital letters at the top of the cover letter. The sample certification that the petitioner is not obligated to pay the fee would be:
�[Name of employer] has over [insert total US employees] employees in the United States, of whom fewer than [insert number or percent] are H-1B or L nonimmigrants. As such, [name of employer] is not subject to the additional fees required under PL 111-230.�

As of June 19, 2009, approximately 44,500 H-1B (http://www.h1b.biz/lawyer-attorney-1137085) cap-subject petitions and approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits, taking into account the fact that some of these petitions may be denied, revoked, or withdrawn.

I-140 belongs to the employer only, so it is up-to them to disclose the details. Unless you change employer without using AC21 clause, I-140 details won't be necessary.

Hi All,
I have efiled for my AP and EAD. I have received the RN for the same. I am planning to travel out of country by end of November. I am pretty sure AP will not be approved by that time. I am planning to travel on H1B visa. My attorney tells me that AP will not be approved if I travel before it is approved. I have to be in the country in order to get the AP approval. Is that true?

I am planning to sponsor for my in-laws and have a list of all the required documents, but I have a question about the financial/property documents they need to to take. The reason being, my father-in-law is retired and since then they have been living based on he pension and rental from some of the properties they own and have not filed tax returns.
Will getting the property evaluation and showing cash balance sufficient OR do I need them to take any additional documentation. Their source of income is just the pension and rental properties. Since most of the transactions happen in CASH in India, they don't have bank statements or records to support the rental property, except for the original property documents associated with the rental properties.
Since I am the sponsor, I have got all the required docs from my side both immigration and financial docs properly. I believe, my in-laws also need to get the property and other docs handy to prove the ties back to the home country.
Please advice...

If you have filed G28, your attorney on record will get the approval notice (3 hard copies).
On USCIS website, my I131 messages says as Document approved and..so on on Nov 1. Till date I haven'yt recd. any copies yet. Will it come to me or Lawyers?
